New Cottage Food Law is “Buyer Beware”- Eat at Your Own Risk

YAVAPAI COUNTY, Arizona. –  On March 29, 2024, Governor Hobbs signed HB2042 into law. The bill expands the current cottage food law to allow certain foods that require temperature control (perishable foods). You can view a detailed legislative summary here. The Arizona Department of Health Services is required to write rules that are consistent with the new law. While these rules are yet to be written and information could change based on final decisions, if you have any questions, contact AZDHS Cottage Food Program. 

Please note: This law is effective immediately. All food must be packaged and labeled before leaving the home.

Arizona Department of Health Services administers the Cottage Food Program, including in Yavapai County. To make food under the Cottage Food Program an individual must be registered with Arizona Department of Health Services. For more information visit AZDHS Cottage Food Program.

Cottage food products can be sold in stores and restaurants. If the cottage food product is sold in a separate section of the store or restaurant on a separate display case from non-homemade food items and the vendor displays a sign that indicates that the cottage food products are homemade and exempt from state licensing and inspection. More specific requirements may be included in rules written by the Arizona Department of Health Services

Cottage food cannot be used as an ingredient in other foods prepared at a store or restaurant. While cottage foods can be sold at stores and restaurants, they cannot be mixed with, or used as an ingredient in, other foods at the store or restaurant.
